Terms of Service

1. Parties and Definitions

These Terms of Service ("Terms") govern the relationship between Bulut Studio (the operator of Hifly), providing the Hifly service available at hifly.app ("we", "us"), and any individual using the site or creating an account ("User"). The Terms become effective when the User checks the "I accept" box during registration.

Key terms used:

• Hifly: AI-powered music generation platform developed and operated by Alptekin Bulut.
• Service: All pages, generation flows, account features, and related digital functionality at hifly.app.
• Generation: An audio track produced on Hifly based on the User's instructions.
• Revision: Re-processing of an existing generation (a new version).
• Extension: Adding additional sections to an existing generation.
• Plan: Membership in Free or Hifly Pro.
• Credit: A unit consumed per generation.

2. Scope of the Service

Hifly transmits the User's text or selections (mood, environment, theme) to a music generation model and produces an audio track. The Service relies on technology that is still evolving; we do not guarantee that every output will fully meet expectations.

Hifly provides: Generation, Revision, Extension, lyrics view and saving, history and playback.

3. Account Creation and User Responsibilities

3.1. You must be at least 13 years old to create an account. To purchase a paid plan, you must be at least 18 years old and have legal capacity in your jurisdiction.

3.2. You agree to provide accurate, current, and complete information at registration. Hifly may suspend or close accounts that provide false or misleading information.

3.3. You are responsible for the security of your account. Hifly is not liable for damages caused by sharing or theft of your password.

3.4. Each User may have only one active account. Abusing the Free plan or promotions through multiple accounts is prohibited.

4. Plans and Pricing

4.2. Prices are shown in U.S. Dollars ($). VAT and sales tax are calculated automatically at checkout and collected by our payment provider.

4.3. Hifly may change plans, scope, and pricing with prior notice. For active subscriptions, changes apply at the next renewal cycle.

4.4. Plan benefits are tied to the subscription period; unused daily credits do not roll over.

5. Free Plan Terms

5.1. The Free plan starts automatically at registration and has no time limit. Users may generate 5 new songs per month; the monthly limit resets on the 1st of each month UTC.

5.2. The Free plan requires no payment information.

5.3. The song-extend feature is disabled on the Free plan; revisions are available on the Free plan with 1 per song.

6. Payment and Invoicing

6.1. Paid plans are processed through Lemon Squeezy (Lemon Squeezy, Inc.; PCI-DSS Level 1), which acts as the Merchant of Record (seller and reseller of record) for all transactions; Lemon Squeezy is responsible for payment processing, tax, and invoicing. Hifly is a software service operated by Bulut Studio. Card details are never received by Hifly or Bulut Studio servers; they are collected and processed directly on Lemon Squeezy's secure infrastructure.

6.2. Subscriptions auto-renew monthly. Users can stop the next renewal at any time via the Lemon Squeezy customer portal (hifly.app/account → Manage Subscription) or the link in their purchase receipt.

6.3. Invoicing: Lemon Squeezy delivers an electronic receipt after each purchase. As Merchant of Record, Lemon Squeezy provides official tax invoices.

6.4. If payment fails, Lemon Squeezy retries automatically (dunning) for 7 days; if failure persists, the subscription is suspended and the account reverts to the Free plan.

7. Right of Withdrawal and Refunds

Refund and withdrawal terms are detailed in our Refund Policy (hifly.app/refund). Summary:

7.1. A full refund within 14 days of subscription purchase is available only if no generations have been produced.

7.2. Once the first generation is made under the subscription, the right of withdrawal lapses (digital content consumed). No refund for the remaining period; renewal can be cancelled at any time.

7.4. Full-refund exceptions: more than 24 hours of service downtime, double-billing, payment to the wrong plan.

7.5. Refund requests are submitted to support@hifly.app and resolved within 5 business days.

8. Rights to Generated Content

8.1. Hifly places no restriction on using the songs you generate for any personal or commercial purpose, sharing them on social media, or uploading them to distribution platforms; such uses are at the User's discretion.

8.2. You represent that your generation prompts and the resulting output do not infringe third-party rights.

8.3. Hifly may process generated content in anonymous form for service improvement (quality measurement, model improvement) and statistical purposes. Your identity is not visible in these processes.

8.4. If Hifly wishes to use User-generated content for advertising, promotion, or marketing, separate explicit consent is obtained.

8.5. AI-generated content. Music created on Hifly is produced by an AI music engine. The copyright status of AI-generated content varies by country; in some jurisdictions, content generated solely by AI may not qualify for copyright protection. Hifly does not guarantee that exclusive copyright will vest in the music you generate. Before using, publishing, or commercially exploiting generated content, the User is responsible for compliance with the law in their jurisdiction. Shaping the lyrics and arrangement with your own creative input strengthens your legal position.

9. Prohibited Uses

You agree not to use Hifly to:

9.1. Generate content that infringes third-party copyright.

9.2. Generate or share unlawful, obscene, hate-speech, violent, or content that endangers minors.

9.3. Imitate a real person's voice or likeness to create deceptive content.

9.4. Abuse the Service via automated tools (bots, scraping, artificially inflating credit usage).

9.5. Gain unauthorized access to the Service infrastructure, search for vulnerabilities, reverse-engineer, or inject malware.

9.6. Abuse promotions, discounts, or the Free plan via multiple accounts.

In case of violation, Hifly may suspend the account without warning, delete content, or terminate it permanently; paid fees are not refunded.

10. Service Interruptions, Maintenance, and Changes

10.1. Hifly may temporarily suspend the Service for planned maintenance, infrastructure updates, or mandatory security interventions; where possible, at least 24 hours' notice is given.

10.2. Removal of features, scope changes, or pricing updates are notified to Users by email at least 30 days in advance.

10.3. The Service is not guaranteed to be uninterrupted or error-free.

11. Account Suspension and Termination

11.1. Users may close their account at any time via hifly.app/account or support@hifly.app. Subscriptions end at the next renewal cycle; refunds for unused credit are evaluated under the Refund Policy.

11.2. Hifly may suspend or close an account upon detection of prohibited uses (Section 9), payment dispute, or arising legal obligation. The User is notified by email.

11.3. Account closure does not require refund of fees paid up to that date.

12. Limitation of Liability

12.1. Hifly produces output via an AI generation model. No guarantee is given regarding emotional, artistic, or musical quality of the output.

12.2. Hifly is not liable for any data loss, lost profits, lost business opportunities, indirect, or punitive damages arising from use of the Service.

12.3. Hifly's total liability is limited to the total Hifly fees paid by the User during the last 12 months.

12.4. If User-generated content infringes third-party copyright, legal liability rests with the User.

13. Intellectual Property

13.1. The Hifly brand, logo, Bulut Studio name, all written content, design, graphic elements, source code, and visual material on hifly.app belong to Alptekin Bulut. Unauthorized copying, reproduction, or use as derivative works is prohibited.

13.2. User-generated songs are governed by Section 8; the Hifly infrastructure and models are provided to the User as a permission to use only, not as a license under these Terms.

14. Privacy and Personal Data

Processing of personal data is governed by the Privacy Policy and the KVKK Disclosure (Turkish data subjects), available at hifly.app/privacy and hifly.app/kvkk.

15. Dispute Resolution

15.1. These Terms are governed by the laws of the Republic of Turkey.

15.2. For consumer disputes, Users may apply to the Consumer Arbitration Committee (within monetary thresholds set annually by the Turkish Ministry of Trade), or to the Consumer Courts for amounts above the threshold.

15.3. For non-consumer disputes, Istanbul courts and execution offices have jurisdiction.

15.4. Users in jurisdictions outside Turkey retain any non-waivable rights provided by their local law.

16. Effectiveness and Changes

16.1. These Terms become effective when the User checks "I accept" during registration.

16.2. Hifly may update these Terms periodically. Material changes are notified to the registered email address at least 30 days in advance; continued use of the Service during this period constitutes acceptance of the new Terms.

16.3. If any provision of these Terms is held invalid by a competent court, the remaining provisions remain in effect.
